Expanding your protection overseas
The Madrid System can let you seek trade mark protection in multiple countries through a single international application based on your Australian trade mark application or registration. We’ll assess whether it’s suitable for your markets and help you choose the countries that make sense for your business.
Choosing the right countries
You don't need to file everywhere. We help you prioritise the markets where you’re trading, manufacturing or planning to expand.
Managing local requirements
Not every country is covered by the Madrid System. Where a direct national filing is required, we can coordinate with trusted overseas associates to manage the application and local requirements on your behalf.
Before you file overseas
Before filing, we’ll help you consider:
which markets are important to your business
whether your Australian trade mark is suitable as the basis for an international application
whether the mark is available in the countries you’re targeting
which goods and services should be protected
whether Madrid System or direct national filings are more appropriate
the likely filing and ongoing costs
Is your brand available overseas?
An Australian Trade Mark Search won't tell you whether your brand is available in another country. Before entering a new market, we can help identify existing trade marks that may create a problem and advise on the risks before you invest in launching there.
One application doesn't mean one global trade mark
The Madrid System simplifies the process of seeking protection in multiple countries, but each designated country or region applies its own trade mark laws when examining the application. A refusal in one country does not necessarily mean the application will be refused elsewhere.
